FTP 2023 Amended: One Star Export House Eligibility

The Central Government has amended Para 1.25(d) of the Foreign Trade Policy (FTP), 2023, introducing a specific relaxation for exporters applying for One Star Export House status.

Under the amendment, exporters other than those in the Gems & Jewelry Sector can qualify for One Star Export House status based on export performance achieved in any two of the three preceding financial years, subject to the other applicable provisions of Para 1.25 of FTP, 2023.

The amendment has been made with immediate effect under the powers conferred by the Foreign Trade (Development & Regulation) Act, 1992.

What Has Changed in Para 1.25(d)?

Previously, Para 1.25(d) required export performance in all three preceding financial years for granting status, while the Gems & Jewelry Sector required performance in all two preceding financial years.

The revised provision introduces an exception specifically for One Star Export House status.

Revised Eligibility for One Star Export House

For applicants other than those belonging to the Gems & Jewelry Sector:

  • Export performance in any two out of the three preceding financial years will be sufficient.
  • The relaxation applies specifically to One Star Export House status.
  • Other applicable requirements under Para 1.25 of FTP, 2023 continue to apply.

Who Can Benefit From the Amendment?

The amendment is particularly relevant to exporters who have maintained export activity but may not have recorded export performance in each of the three preceding financial years.

An exporter, other than from the Gems & Jewelry Sector, may now meet the export-performance requirement for One Star Export House status through performance in any two of the three preceding financial years, provided the remaining requirements under FTP 2023 are satisfied.

Example

Suppose an eligible exporter has export performance during:

  • FY 2023–24 – Yes
  • FY 2024–25 – No
  • FY 2025–26 – Yes

Under the revised Para 1.25(d), export performance in FY 2023–24 and FY 2025–26 can satisfy the specified performance requirement for One Star Export House status, subject to the other provisions of Para 1.25.

Key Impact of the Amendment

The amendment provides greater flexibility to eligible exporters seeking recognition under the Status Holder Scheme.

Businesses with an uneven export-performance history across the preceding three financial years may now have an opportunity to qualify for One Star Export House status without requiring export performance in every one of those three years.

Important Compliance Point

The relaxation relates to the export-performance requirement under Para 1.25(d). It does not mean that all other conditions for obtaining One Star Export House status have been removed.

Applicants should therefore review the complete requirements of Para 1.25 of FTP, 2023 before applying.

Note:

The relaxation applies to One Star Export House applicants other than the Gems & Jewelry Sector. Other applicable provisions of Para 1.25 of FTP, 2023 remain relevant.

Conclusion

The amendment to Para 1.25(d) of FTP, 2023 provides an important relaxation for exporters seeking One Star Export House status.

With immediate effect, eligible applicants outside the Gems & Jewelry Sector can rely on export performance in any two of the three preceding financial years, subject to the other provisions of Para 1.25.

Exporters planning to apply for status should review their export-performance records and verify all applicable eligibility requirements before submitting their application.
